Terms of Service

These Terms govern your access to and use of CollectMonial (the “Service”) operated by CollectMonial (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.

You must provide accurate information when creating your account and keep your credentials secure. You are responsible for all activity that happens under your account. Notify us at support@collectmonial.com if you suspect unauthorized access.

Paid plans are billed in advance on a recurring basis (monthly or annually, depending on plan). Payments are processed by Dodo Payments. By subscribing you authorize us to charge the payment method you provide for the applicable fees plus any taxes, on a recurring basis until you cancel.

You can cancel at any time from the dashboard. Cancellation takes effect at the end of your current billing period. We don't offer refunds for partial periods unless required by law.

We may change pricing at any time. Existing subscribers will be notified of price changes at least 30 days before they take effect.

You retain ownership of the testimonials, branding, media, and other content you upload or import (“Your Content”). You grant us a non-exclusive, worldwide license to host, store, display, and process Your Content solely to operate the Service for you — for example to render your testimonial widget on your customers' sites.

You represent that you have all rights necessary to upload and use Your Content, including consent from the people featured in any testimonial you collect or import.

You agree not to use the Service to:

• Violate any law or infringe anyone's rights.
• Upload or transmit malware, harassing content, content that is illegal, defamatory, or sexually explicit involving minors.
• Scrape, brute-force, or circumvent rate limits or access controls.
• Misrepresent the source of a testimonial or fabricate testimonials attributed to people who did not provide them.
• Resell, sublicense, or white-label the Service without our written permission.

We may suspend or terminate accounts that violate these rules.

We work to keep the Service available but don't guarantee uninterrupted access. Planned maintenance, third-party outages, and bugs can cause downtime. The Service is provided “as is” without warranties of any kind to the maximum extent permitted by law.

To the maximum extent permitted by law, in no event will we be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.

You agree to defend and indemnify us against claims arising from Your Content, your use of the Service in violation of these Terms, or your violation of applicable law.

You can delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms, fail to pay, or if required by law. On termination your right to use the Service ends immediately. Provisions that by their nature should survive termination (e.g., ownership, indemnity, limitation of liability) will survive.

We may update these Terms from time to time. Material changes will be announced via email or in-app notice. Continuing to use the Service after an update means you accept the revised Terms.

These Terms are governed by the laws of the jurisdiction of our principal place of business, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction.
